Bill Pushed That Would Enable Gun Violence Victims to Sue Gun Manufacterers

The law would try to reverse the laws in place that protect gun makers

Rep. Adam Schiff (D-CA) and Sen. Richard Blumenthal (D-CT) are pushing a bill to allow crime victims to sue gun makers for redress.

The bill would also allow suits to be brought against gun sellers.

 

According to The Hill, the bill is being pushed to reverse the Protection of Lawful Commerce in Arms Act (PLCAA), which was passed in 2005 and signed into law by George W. Bush. The PLCAA protects gun manufacturers from suits stemming from the misuse of their products, but Democrats–particularly Schiff–present the PLCAA as shielding gun manufacturers even in the event of the production of a faulty product.

 

Schiff said, “If you’re a pharmaceutical company and sell faulty drugs, you can be held liable. If you’re a liquor store and sell alcohol to minors, you can be held liable.” He added, ““Why should it be any different for gun manufacturers?”

 

The problem with Schiff’s argument is that gun makers do not have immunity from lawsuits over faulty products. For example, Remington gun owners were recently informed of a class action lawsuit against the gun maker over allegedly faulty trigger mechanisms, and just last year Forja Taurus SA reached a $30 settlement in a class action lawsuit over an alleged “drop fire defect” in certain Taurus pistols.

 

The PLCAA was not intended to allow gun makers to create faulty products with impunity but to protect them from being sued by money hungry trail lawyers and anti-gun groups every time someone buys a gun legally, then misuses the weapon. President Bush recognized such an approach to lawsuits would soon bankrupt and erase the gun industry, so he moved to protect them.

 

Schiff and Blumenthal are now pushing to remove those protections.

I can just see the chaos unfolding now. Parents of thugs, gangsters or teen robbers would set out to sue the manufacturer of the gun that killed their “innocent babies.” Because forget logic- there will always be people who are unwilling to accept responsibility for their actions but instead place the blame on the gun.
cloak tuck 3.0For instance, the Sandy Hook Elementary shooting. Several of the parents went after the manufacturers of the Bushmaster assault rifle, the gun that Adam Lanza used in the shooting. The gun didn’t do anything by itself, it was the coward behind the gun that was solely responsible.

I think it’s ridiculous that people would even consider it being the gun or gun maker’s fault. This whole idea, of allowing those victimized by gun violence the right to sue the makers of the tool that shot them, is just such a joke. Did anyone forget about the criminal that was controlling the gun?

Raising awareness on laws being pushed like this one is just crucial for the freedom of our country. Ridiculous laws like this must be called out and cut off.

    So with this logic anyone that has ever been hurt by a drunk driver can go back and sue the car maker for damages. This is not even a logical defense for gun control its just another backdoor attack from the left to slow the manufacturing of guns and make it harder for law abiding citizens to protect themselves TIME TO WAKE UP AMERICA

    Didn’t these bastards take an oath of office? We have a president that is threatening our very way of life and this is what they find important? Good grief! Guns are a danger, but funding terrorism and releasing terrorist’s doesn’t seem to be a problem with these two shameful men.

    This is absolutely insane. If in fact this has taken place, I recommend that an automatic investigation be launched in to the records of those lawmakers to include financials. This could bite them in the ass. Imagine, a soldier in a war, i.e., the Middle East being shot by a weapon built in the US, suing that manufacturer. This might be a stretch but it same. Shoot, next, some brainiac will want to sue the designer of that weapon. Lawmakers need to do a reality check!

    Does this mean that car manufacturers could be sued for reckless driving of an individual or that cell phone manufacturers could be sued for injuries caused by idiots texting while driving and causing accidents? America knows that politicians are never held to account for their actions or lack thereof but the rest of society must be held accountable for their actions.

    Well I guess we can sue auto makers because there car kill one our loved one , I can’t believe some one could be this dum , law makers need get there heads screwed on right.

    If passed, could a knife manufacturer, or perhaps a chain saw manufacturer etc be sued. Of course the question of inheritantly dangerous items come into play then. Like Dynamite is, a vehicle isn’t. Stop the madness! The person who has control or lack of control is to blame. Stop blaming others for the actions of criminals and irresponsible people.

    Sure I’m all for it as long as I can sue the automobile manufacturer if I’m injuried in car accident.
