Landlord Threatens Eviction for Owning Gun After Tenant Shoots Burglar in Self-Defense

When robbed several times, man gets gun and sues no-gun apartments for right to use it

A disabled, retired lobsterman from Maine had not been having a good time with robberies. Harvey Lembo had been robbed 5 times before he finally decided to get a gun.

It payed off within 12 hours of buying the gun, a burglar decided to pop in and rummage through Lembo’s things. The 67 year old survived three heart attacks, has chronic pain and diabetes, and he believed he kept getting targeted because of his medications. Lembo shot the burglar in the shoulder when he came at Lembo who was dialing 911.

The burglar was later caught, and you would think Lembo’s landlord would be glad that he was safe and put a robber out of commission, but instead Lembo’s property management warned him that firearms are are not allowed in the apartments.

Thats when the disabled man got fed up and decided to file a lawsuit against Standford Management Co., his property management.

“We’re interested in ensuring that people in Mr. Lembo’s position are able to enjoy their full constitution rights, including their right to lawfully possess a firearm in self-defense,” said Patrick Strawbridge, his Boston-based attorney.

 

The National Rifle Association applauded the lawsuit, which contends the landlord interfered with Lembo’s constitutional right to bear arms and violated the MaineCivil Rights Act.

 

“Threatening to evict Mr. Lembo for defending himself clearly violates his constitutional rights,” John Hohenwarter, an NRA Maine state liaison, said in a written statement. “Self-defense is a fundamental, God-given right that belongs to every law-abiding American — no matter their tax bracket, zip code or street address.”

It either sounds like this lawsuit is going to work out for Lembo thanks to publicity, or Mr. Lembo needs to find a new place to live. An apartment complex that doesn’t allow guns provides lovely, worry-free places for criminals to do what they please. That is not an apartment complex I would want to live in…

2 holster comboYou would think that more people would start to catch on that gun-free zones are killing zones, they are havens for cowards and murderers to go about their schemes undeterred. 92% of mass shootings from 2009 t0 ’14 happened in gun-free zones.

Preventing victimization of the innocent goes hand-in-hand with the Second Amendment, and like Mr. Lembo, never allow that right to be infringed.
